DEFINITIONS
In these Terms, the following words have the meanings set out below:
"ACL" means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
"Agreement" means these Terms and Conditions together with any document incorporated by reference, including our Privacy Policy, Returns & Exchanges Policy, Shipping Policy, Cookie Policy, and Born To Work Promise.
"Born A Real K9", "we", "us", "our" means Born A Real K9 Pty Ltd (ABN 81 690 596 000), a company registered in Australia, with registered address at Level 1, 63-73 Ann St, Surry Hills NSW 2010.
"Consumer Guarantees" means the guarantees applicable to goods and services under Part 3-2 of the ACL.
"Content" means all text, images, photographs, videos, graphics, logos, product names, brand names, and other material published on the Website.
"Order" means a request by you to purchase one or more Products through the Website.
"Products" means the goods listed for sale on the Website, including dog collars, leads, harnesses, training equipment, treat bags, grooming products, and accessories.
"Website" means the e-commerce website operated by Born A Real K9 at bornarealk9.com, hosted on the Shopify platform.
"You", "your" means the person accessing the Website or placing an Order.
1. ACCEPTANCE OF TERMS
1.1 Agreement to Terms By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website or place an Order.
1.2 Acceptance by Ordering By completing the checkout process and placing an Order, you confirm that you have read, understood, and accepted these Terms in full.
1.3 Age Requirement You must be at least 18 years of age to place an Order. By placing an Order, you represent and warrant that you are 18 years of age or older. If you are under 18, you may only use the Website with the involvement and consent of a parent or legal guardian.
1.4 Updates to Terms We reserve the right to update or amend these Terms at any time. The updated Terms will be published on the Website with a revised "Last Updated" date. Your continued use of the Website after any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
2. WEBSITE ACCURACY
2.1 Reasonable Efforts We make reasonable efforts to ensure that information on the Website is accurate and current. However, specifications, availability, pricing, images, and descriptions may occasionally contain errors or omissions and may be updated without notice. We reserve the right to correct any errors and to update information at any time without liability to you.
2.2 No Warranty as to Accuracy To the maximum extent permitted by law, Born A Real K9 does not warrant that the Website or its content is complete, accurate, current, or free from error. Nothing in this clause limits your rights under the ACL.
3. PRODUCTS
3.1 Product Descriptions We take reasonable care to ensure that product descriptions, specifications, and details on the Website are accurate. However, we do not warrant that descriptions are complete, current, or free from error.
3.2 Images and Colour Variations Product images are provided for illustrative purposes only. Colours, textures, and finishes may vary from those displayed on screen due to differences in monitor calibration, screen resolution, and photographic lighting. Such variation does not constitute a defect.
3.3 Product Availability All Products are subject to availability. We reserve the right to limit quantities, discontinue Products, or withdraw Products from sale at any time without notice.
3.4 Manufacturing Updates and Product Improvements Born A Real K9 is committed to continuous product improvement. We reserve the right to make changes to materials, components, hardware, or design specifications at any time. Updated products may differ from images or descriptions previously published on the Website. Such changes do not affect your rights under the ACL.
3.5 Future Products These Terms apply to all current and future Products offered by Born A Real K9, including products developed for working dogs and active companion dogs.
4. PRICING
4.1 Currency All prices displayed on the Website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable, unless otherwise stated.
4.2 GST Born A Real K9 is registered for GST. GST is included in the displayed price for all taxable supplies. A tax invoice will be provided upon request.
4.3 Pricing Errors We take reasonable steps to ensure pricing accuracy. In the event of a pricing error, we reserve the right to cancel or decline an Order placed at an incorrect price. If your Order has already been processed and payment taken, we will contact you promptly and offer you the option to proceed at the correct price or receive a full refund.
4.4 Promotions and Discount Codes Promotional pricing, discount codes, and special offers are subject to their own terms and conditions, including expiry dates and eligibility criteria. Discount codes must be applied at checkout and cannot be applied retrospectively. Only one discount code may be applied per Order unless otherwise stated. We reserve the right to withdraw or modify any promotion at any time without notice and to cancel Orders where a promotion has been applied fraudulently or in breach of its terms.
4.5 Gift Cards Gift cards are redeemable for Products on the Website only. Gift cards have no cash value, are non-refundable, and cannot be exchanged for cash. Expiry dates, where applicable, will be stated at the time of issue. Lost or stolen gift cards cannot be replaced.
5. ORDERS
5.1 Order Placement Placing an Order constitutes an offer by you to purchase the relevant Products at the stated price. An Order is not accepted until we send you an order confirmation by email. We reserve the right to decline any Order at our discretion.
5.2 Order Cancellation Once an Order has been placed, cancellation may not be possible if the Order has already been dispatched. Please contact us at support@bornarealk9.com as soon as possible if you wish to cancel. We will make reasonable efforts to accommodate cancellation requests received before dispatch.
5.3 Fraud Prevention and Verification We reserve the right to verify your identity and payment details before processing an Order. We may request additional information to confirm the legitimacy of an Order. Orders suspected of being fraudulent or placed in breach of these Terms may be cancelled without notice.
5.4 Stock Availability and Backorders Where a Product is out of stock at the time of your Order, we will notify you by email. You may choose to wait for the Product to become available (backorder), select an alternative Product, or receive a full refund. We do not guarantee availability timeframes for backordered Products.
5.5 Partial Fulfilment Where an Order contains multiple Products and one or more items are unavailable, we may fulfil the Order in part and dispatch available items. We will notify you of any partial fulfilment and arrange a refund or backorder for the unavailable items, at your election.
5.6 Incorrect Shipping Addresses You are responsible for providing a complete and accurate shipping address at checkout. Born A Real K9 is not liable for Orders delivered to an incorrect address provided by you. If an Order is returned to us due to an incorrect address, we will contact you to arrange redelivery at your cost.
5.7 Refused Deliveries and Uncollected Parcels If a delivery is refused by you or a parcel is not collected from a collection point within the carrier's specified timeframe and is returned to us, we will contact you to arrange redelivery at your cost. We are not responsible for any loss or damage arising from a refused delivery or uncollected parcel.
6. PAYMENT
6.1 Accepted Payment Methods We accept payment via the methods displayed at checkout, which may include credit and debit cards, and other payment options facilitated through Shopify Payments or approved third-party payment providers.
6.2 Shopify Payments and Third-Party Providers Payment processing is facilitated by Shopify Payments and may involve third-party payment providers. By providing your payment details, you authorise us to charge the total Order amount, including any applicable shipping fees. Your payment information is processed securely by the relevant payment provider and is not stored by Born A Real K9.
6.3 Payment Authorisation All payments are subject to authorisation by your financial institution. We are not responsible for any fees, charges, or delays imposed by your bank or payment provider.
6.4 Chargebacks If you initiate a chargeback or payment dispute with your financial institution without first contacting us to resolve the matter, we reserve the right to suspend your account and decline future Orders. We will cooperate fully with any legitimate dispute resolution process.
7. SHIPPING
7.1 Shipping Policy Shipping, dispatch times, delivery estimates, and carrier information are governed by our separate Shipping Policy, available on the Website. By placing an Order, you agree to the terms of our Shipping Policy.
7.2 Dispatch Times We aim to dispatch Orders within the timeframes stated in our Shipping Policy. Dispatch times are estimates only and are not guaranteed. Delays may occur during peak periods, public holidays, or due to circumstances beyond our control.
7.3 Delivery Estimates Delivery timeframes provided at checkout are estimates provided by our carrier partners and are not guaranteed. Born A Real K9 is not liable for delays caused by carriers, customs authorities, or other third parties.
7.4 Risk of Loss Risk of loss or damage to Products passes to you upon delivery to the address specified in your Order. If you have nominated an authority to leave, risk passes when the parcel is left at the nominated location.
7.5 Lost Parcels If your parcel is lost in transit, please contact us at support@bornarealk9.com. We will liaise with the carrier on your behalf. Where a parcel is confirmed lost, we will offer a replacement or refund in accordance with our Shipping Policy and your rights under the ACL.
7.6 International Shipping We ship to selected international destinations as listed in our Shipping Policy. International customers are responsible for all import duties, taxes, customs fees, and any other charges imposed by the destination country. Born A Real K9 has no control over and accepts no liability for such charges. Delivery timeframes for international Orders are estimates only.
8. RETURNS & EXCHANGES
8.1 Returns & Exchanges Policy Our returns and exchanges process is governed by our separate Returns & Exchanges Policy, available on the Website. By placing an Order, you agree to the terms of that Policy.
8.2 Change-of-Mind Returns We offer a 30-day change-of-mind returns policy for eligible Products, subject to the conditions set out in our Returns & Exchanges Policy. Products must be unused, in original condition, and in original packaging to be eligible. Change-of-mind returns are a discretionary benefit we provide in addition to your rights under the ACL and do not affect those rights.
8.3 Store Credit and Exchanges Where a return is accepted, we may offer store credit or an exchange in accordance with our Returns & Exchanges Policy.
8.4 Australian Consumer Law Rights Nothing in these Terms limits, excludes, or modifies your rights as a consumer under the ACL. If a Product has a major failure, you are entitled to a replacement or refund. If a Product has a minor failure, we are entitled to repair or replace the Product. These rights exist independently of and in addition to any discretionary policy we offer.
9. BORN TO WORK PROMISE
9.1 Voluntary Promise The Born To Work Promise is a voluntary promise offered by Born A Real K9 in addition to your rights under Australian Consumer Law. Details of coverage, including manufacturing defects, are set out in our separate Born To Work Promise page on the Website.
9.2 Relationship to Consumer Guarantees The Born To Work Promise operates in addition to, and does not limit or replace, your rights under the Consumer Guarantees in the ACL. Where the Born To Work Promise provides a benefit that exceeds your statutory rights, that additional benefit is provided at our discretion and subject to the terms of that policy.
9.3 Manufacturing Defects Where a Product is found to have a manufacturing defect, your remedy will be determined in accordance with the Born To Work Promise and, where applicable, the ACL. Defects caused by misuse, improper care, or use inconsistent with the Product's intended purpose are not covered under the Born To Work Promise. Cosmetic wear and normal deterioration resulting from regular use are not manufacturing defects for the purposes of the Born To Work Promise. This does not affect any rights you may have under the Australian Consumer Law.
10. PRODUCT SAFETY
10.1 Intended Use All Products must be used only for their intended purpose as described on the Website and on product packaging. Born A Real K9 accepts no liability for injury, loss, or damage arising from use of a Product in a manner inconsistent with its intended purpose.
10.2 Supervision Dogs should be supervised at all times when wearing or using any Product. No collar, lead, harness, or accessory should be left on an unsupervised dog unless specifically designed and labelled for that purpose.
10.3 Owner Responsibility You are responsible for selecting Products that are appropriate for your dog's size, breed, temperament, activity level, and training stage. Born A Real K9 provides general product information to assist your selection, but the final decision rests with you as the owner. Improper use of any Product is at your own risk.
10.4 Variation in Dogs Dogs vary in size, strength, behaviour, and temperament. No product can eliminate all risks associated with dog ownership. Owners remain responsible for regularly inspecting Products for wear and replacing them where necessary.
10.5 Hardware and Equipment Inspection Owners should inspect collars, leads, harnesses, hardware, stitching, and buckles before and after each use and discontinue use if excessive wear or damage is observed. Regular inspection is particularly important for Products used in high-activity or working environments.
10.6 Working Dog and Active Use Many Born A Real K9 products are designed for working dogs and active companion dogs. Working environments place greater stress on equipment than normal domestic use. Cosmetic wear and normal deterioration resulting from regular use are not manufacturing defects for the purposes of the Born To Work Promise. This does not affect any rights you may have under the Australian Consumer Law.
11. TRAINING EQUIPMENT DISCLAIMER
11.1 Responsible Use Training Products sold by Born A Real K9 are intended to assist responsible dog owners and professional trainers. They are tools, not substitutes for proper training, professional guidance, or responsible ownership. Training equipment should only be used by competent handlers or under appropriate supervision.
11.2 No Professional Advice Born A Real K9 does not provide veterinary, behavioural, or professional dog training advice through the sale of Products or through any content published on the Website. Nothing on the Website constitutes professional training or behavioural advice. If you have concerns about your dog's behaviour or health, please consult a qualified veterinarian or accredited dog trainer.
11.3 Use at Owner's Risk Training equipment must be used responsibly and in accordance with the manufacturer's instructions. Misuse of training equipment may cause injury to your dog or others. Born A Real K9 accepts no liability for injury or damage arising from improper use of training Products.
12. DOG CARE PRODUCTS
12.1 External Use Only Grooming products, shampoos, ear wipes, paw balm, and similar Products are intended for external animal use only, unless otherwise stated on the product label.
12.2 Avoid Eyes Avoid contact with your dog's eyes unless the product label specifically states it is safe for use around eyes.
12.3 Avoid Ingestion These products are not intended for ingestion. Keep out of reach of children. Do not allow animals to ingest any grooming or care product unless specifically formulated and labelled for that purpose.
12.4 Open Wounds Do not apply grooming or care products to open wounds, broken skin, or irritated areas unless the product label specifically directs otherwise.
12.5 Discontinue Use if Irritation Occurs If your dog shows any sign of irritation, allergic reaction, or adverse response, discontinue use immediately and seek veterinary advice.
12.6 Veterinary Advice If your dog has a known skin condition, allergy, or health concern, consult your veterinarian before using any grooming or care product.
12.7 Label Directions and Storage Always read and follow the directions on the product label. Keep products in their original container. Store all Products in accordance with the instructions on the product label, away from direct sunlight and heat, and out of reach of children.
13. WEBSITE USE
13.1 Permitted Use You may use the Website for lawful personal and commercial purposes in accordance with these Terms. You must not use the Website in any way that is unlawful, harmful, or that interferes with the operation of the Website or the experience of other users.
13.2 Prohibited Conduct You must not:
(a) use the Website for any fraudulent, deceptive, or unlawful purpose;
(b) attempt to gain unauthorised access to any part of the Website, its servers, or any connected systems;
(c) attempt to interfere with or disrupt the security, functionality, or performance of the Website;
(d) introduce viruses, malware, or other harmful code to the Website;
(e) scrape, harvest, or systematically extract data from the Website without our prior written consent;
(f) use automated tools, bots, or scripts to interact with the Website;
(g) reproduce, republish, or redistribute any Content without our prior written consent;

14. INTELLECTUAL PROPERTY
14.1 Ownership All Content on the Website, including but not limited to the Born A Real K9 logo, brand name, product names, photography, videos, graphics, written content, and website design, is owned by or licensed to Born A Real K9 Pty Ltd and is protected by Australian copyright law, trade mark law, and other applicable intellectual property laws.
14.2 Proprietary Product Branding All product names, including COAT FORCE™, PAW FORCE™, EAR FORCE™, and BORN TO WORK PROMISE™, are proprietary branding of Born A Real K9 Pty Ltd where applicable. Nothing in these Terms grants you any right to use these names or marks without our prior written consent.
14.3 No Reproduction Without Permission You must not reproduce, copy, distribute, modify, transmit, display, publish, or create derivative works from any Content without our prior written consent. Requests for permission may be directed to support@bornarealk9.com.
14.4 Trade Marks "Born A Real K9" and associated logos and product names are trade marks of Born A Real K9 Pty Ltd. Nothing in these Terms grants you any right to use our trade marks without our prior written consent.
15. USER GENERATED CONTENT
15.1 Customer Reviews By submitting a review, rating, or comment on the Website, you grant Born A Real K9 a non-exclusive, royalty-free, perpetual licence to display, reproduce, and use that content on the Website and in our marketing materials. We may edit reviews for spelling, grammar, or length, provided the meaning is not materially altered.
15.2 Social Media and Submitted Photos By tagging Born A Real K9 in social media posts, responding to our requests for permission, or submitting photographs to us directly, you grant us permission to feature your content across our Website, social media channels, and marketing materials, with credit where reasonably practicable. You represent that you own or have the right to grant this permission in respect of any content you submit.
15.3 Content Standards You must not submit any content that is defamatory, offensive, misleading, or in breach of any third party's rights. We reserve the right to remove any user-generated content at our discretion.

18. LIMITATION OF LIABILITY
18.1 General Limitation To the maximum extent permitted by law, Born A Real K9's total liability to you for any claim arising out of or in connection with these Terms or your use of the Website or Products is limited to the amount paid by you for the relevant Product(s) giving rise to the claim.
18.2 Exclusion of Consequential Loss To the maximum extent permitted by law, Born A Real K9 excludes all liability for indirect, incidental, special, or consequential loss or damage, including loss of profits, loss of data, or loss of opportunity, arising out of or in connection with these Terms or your use of the Website or Products.
18.3 ACL Carve-Out Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the ACL or any other applicable law that cannot lawfully be excluded or limited. Where the ACL applies, our liability is limited to the extent permitted by section 64A of the ACL, which may include (where applicable) the replacement or repair of goods, the supply of equivalent goods, or the payment of the cost of replacing or repairing the goods.
19. INDEMNITY
19.1 Your Indemnity You agree to indemnify, defend, and hold harmless Born A Real K9 Pty Ltd, its directors, officers, employees, and agents from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

25. PRODUCT RECALLS AND DISCONTINUATION
25.1 Product Recalls In the event that a Product is subject to a recall, we will notify affected customers by email where reasonably practicable and provide instructions for returning the Product and obtaining a remedy in accordance with applicable law.
25.2 Product Discontinuation We reserve the right to discontinue any Product at any time without notice. Discontinuation of a Product does not affect your rights in respect of Products already purchased.
26. COUNTERFEIT PRODUCTS AND UNAUTHORISED RESELLERS
26.1 Authorised Sales Only Born A Real K9 Products are sold exclusively through our Website and any authorised retail channels we designate. We do not authorise the resale of our Products through third-party marketplaces or resellers unless expressly stated.
26.2 No Warranty for Unauthorised Purchases If you purchase a Product from an unauthorised reseller or third-party marketplace, Born A Real K9 cannot verify the authenticity or condition of that Product and does not extend the Born To Work Promise or any discretionary warranty to such purchases. Your statutory rights under the ACL remain unaffected.
26.3 Counterfeit Products Born A Real K9 takes the protection of its brand and intellectual property seriously. If you suspect you have purchased a counterfeit product bearing our brand, please contact us at support@bornarealk9.com.
27. WHOLESALE
27.1 Wholesale Enquiries Born A Real K9 may offer wholesale purchasing arrangements in the future. Any wholesale arrangement will be subject to a separate wholesale agreement and these Terms will apply to the extent they are not inconsistent with that agreement. 28. FORCE MAJEURE
28.1 Force Majeure Events Born A Real K9 is not liable for any failure or delay in performing its obligations under these Terms where that failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemic, epidemic, government action, war, civil unrest, industrial action, fire, flood, power outages, or failure of third-party infrastructure or services.
28.2 Notification Where a force majeure event affects our ability to fulfil an Order, we will notify you as soon as reasonably practicable and will use reasonable endeavours to fulfil the Order once the event has passed. If fulfilment is not possible within a reasonable time, we will offer you a full refund.
29. GOVERNING LAW
29.1 Jurisdiction These Terms are governed by the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia for the resolution of any dispute arising under or in connection with these Terms.
29.2 Australian Consumer Law Nothing in this clause limits any rights you may have under the ACL or any other applicable Australian consumer protection legislation.
30. GENERAL PROVISIONS

Definitions
In this Policy, the following terms have the meanings given below:
ACL means the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Born To Work Promise means the product quality guarantee offered by Born A Real K9 as described at [bornarealk9.com/born-to-work-promise] (or as otherwise published on our Website from time to time).
Change of Mind means a return or exchange request that is not based on a defect, fault, incorrect supply, or breach of a Consumer Guarantee, including where a customer has ordered the wrong size, colour, or product, or has simply changed their preference.
Consumer Guarantee has the meaning given in the ACL, being the statutory guarantees applying to goods and services supplied to consumers.
Manufacturing Defect means a defect arising from a fault in materials or workmanship during the production of a product, as assessed by Born A Real K9 in accordance with the Born To Work Promise and the ACL.
Policy means this Returns & Exchanges Policy.
Return Authorisation means the written approval issued by Born A Real K9 authorising a customer to return a product, including any Return Authorisation Number assigned.

Nothing in this Policy limits, excludes, or modifies any right or remedy you have under the ACL or any other applicable law that cannot be excluded.
2. Australian Consumer Law – Your Statutory Rights
Our products come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
2.1 Consumer Guarantees
Under the ACL, goods supplied to consumers must be:
of acceptable quality (safe, durable, free from defects, acceptable in appearance and finish, and fit for all purposes for which goods of that kind are commonly supplied);
fit for any particular purpose made known to us;
as described; and
accompanied by any express warranties we have made.
2.2 Major Failures
A major failure occurs where:
a reasonable consumer would not have purchased the goods had they known of the problem;
the goods are substantially unfit for their common purpose and cannot easily be remedied within a reasonable time;
the goods are unsafe; or
the goods are significantly different from their description or sample.
Where a major failure exists, you may:
reject the goods and choose a full refund or replacement of the same type; or
keep the goods and seek compensation for the reduction in value.
2.3 Minor Failures
Where a failure is not a major failure, we are entitled to choose between providing a repair, replacement, or refund. We will do so within a reasonable time.
2.4 Compensation
Where you suffer loss or damage that was reasonably foreseeable as a result of a failure to comply with a Consumer Guarantee, you may also be entitled to compensation under the ACL.
2.5 This Policy Operates in Addition to Your Statutory Rights
Our discretionary returns and exchange processes described in this Policy are offered in addition to, and do not limit, your rights under the ACL. Where there is any inconsistency between this Policy and the ACL, the ACL prevails.
3. Change of Mind Returns
3.1 30-Day Change of Mind Policy
We offer a 30-day Change of Mind return period as a discretionary benefit. To be eligible, the following conditions must be met:
the product is unused and in its original condition;
the product is in its original, undamaged packaging;
the return request is submitted within 30 days of the date of delivery;
proof of purchase is provided (see clause 19); and
a Return Authorisation has been issued by Born A Real K9 before the product is returned (see clause 9).
3.2 Remedies for Change of Mind Returns
For eligible Change of Mind returns, we will offer, at our discretion:
an exchange for an alternative product (subject to stock availability); or
Store Credit to the value of the purchase price (excluding original shipping costs, unless otherwise required by law).
Refunds are not provided for Change of Mind returns unless required under the ACL.
3.3 Incorrect Sizing and Selection
If you have ordered the wrong size, colour, or product, we will treat this as a Change of Mind return and offer an exchange or Store Credit in accordance with clause 3.2.
Where an exchange is requested, we will prioritise fulfilling the exchange with the correct size or product, subject to stock availability. If the requested item is unavailable, we will offer Store Credit or, where legally required, a refund.
4. Store Credit
4.1 Issuance
Store Credit is issued to the value of the purchase price of the returned product. Original shipping costs are excluded from Store Credit unless required by law.
4.2 Validity
Store Credit is valid for a minimum of three (3) years from the date of issue, in accordance with the ACL gift card rules.
4.3 Conditions
Store Credit:
is redeemable online at bornarealk9.com;
may be used in part (any unused balance is retained and remains valid until expiry);
cannot be exchanged for cash, unless required by law;
is not transferable; and
will not have its value reduced by any fee or charge during the validity period.
4.4 Balance Enquiries
You may check your Store Credit balance at any time by contacting us at support@bornarealk9.com or through your account on our Website, free of charge.
5. Products Eligible for Change of Mind Returns
The following products are eligible for Change of Mind returns, subject to the conditions in clause 3.1:

Grooming accessories
Grooming products that remain unopened and sealed in their original packaging
6. Products Not Eligible for Change of Mind Returns
The following products are not eligible for Change of Mind returns:
Opened shampoo, ear wipes, paw balm, or any other opened grooming product (for hygiene reasons — see clause 18)
Gift cards
Custom-made products
Personalised products
Clearance or final sale items (marked as such at the time of purchase)
Products showing evidence of misuse, abuse, chewing, modification, accidental damage, improper storage, or normal wear and tear
Products purchased through unauthorised resellers (see clause 21)
Nothing in this clause affects your rights under the ACL in respect of faulty, defective, or incorrectly supplied products.
7. Manufacturing Defects – Born To Work Promise
Manufacturing Defects are assessed separately under our Born To Work Promise, which operates in addition to your rights under the ACL. Please refer to the Born To Work Promise for full details of the assessment process and available remedies.
Where a Manufacturing Defect claim is submitted, we may request additional photographs or the return of the product to assist with our assessment.
Cosmetic wear and normal deterioration resulting from ordinary use, including use in working dog or high-activity environments, are not in themselves Manufacturing Defects. This does not affect your rights under the ACL.
Where a Manufacturing Defect is confirmed, your ACL rights also apply. The Born To Work Promise does not limit or replace those rights.
8. Faulty, Damaged, or Incorrectly Supplied Products
8.1 Contacting Us
If you receive a product that is faulty, damaged, or not what you ordered, please contact us as soon as possible at support@bornarealk9.com. To assist with assessment, please include:
your order number;
a description of the issue; and
photographs clearly showing the fault, damage, or incorrect item.
Prompt notification assists us in resolving your claim efficiently, but does not affect your rights under the ACL.
8.2 Remedies
Where a fault, damage, or incorrect supply is confirmed, we will offer an appropriate remedy in accordance with the ACL, which may include:
repair;
replacement;
refund; or
such other remedy as is required by law.
The remedy offered will depend on whether the failure is a major or minor failure under the ACL (see clause 2).
9. Return Authorisation
9.1 Approval Required
All returns must be approved by Born A Real K9 before the product is sent back to us. Do not return a product without first obtaining a Return Authorisation.
9.2 How to Request
To request a Return Authorisation, contact us at support@bornarealk9.com with your order number, the reason for return, and (where applicable) supporting photographs.
9.3 Return Authorisation Number
Where a Return Authorisation is issued, we will provide you with a Return Authorisation Number. This number must be clearly referenced on your return packaging. Returns received without a valid Return Authorisation Number may experience delays in processing.
9.4 Incorrect Address
Returns sent to an address other than the address specified in your Return Authorisation may delay processing. Born A Real K9 is not responsible for products lost or delayed due to incorrect return addressing.
10. Returns Process
Once a Return Authorisation has been issued, the returns process is as follows:
Step 1 – Submit Request: Contact us at support@bornarealk9.com to initiate your return and obtain a Return Authorisation.
Step 2 – Assessment: We will assess your request and confirm eligibility. We may request additional information or photographs.
Step 3 – Return Item: Once approved, securely package the product and return it to the address specified in your Return Authorisation, including your Return Authorisation Number. Please remove or cover any old shipping labels before sending your parcel to prevent misrouting.
Step 4 – Inspection: Upon receipt, we will inspect the returned product (see clause 11).
Step 5 – Resolution: We will notify you of the outcome and process the applicable remedy (exchange, Store Credit, or refund) within a reasonable time.
11. Inspection
All returned products are inspected upon receipt. We reserve the right to assess the condition of the product before approving any remedy.
Where a claim requires further assessment (including assessment for Manufacturing Defects or ACL-based claims), we will advise you of the expected timeframe.
We reserve the right to refuse a remedy where inspection reveals that the product does not meet the return conditions applicable to the claim type, or where we reasonably believe a claim is fraudulent (see clause 22).
Nothing in this clause limits your rights under the ACL.
12. Return Shipping
12.1 Faulty, Damaged, or Incorrectly Supplied Products
Where a return is required due to a fault, damage, or incorrect supply confirmed by Born A Real K9, we will cover the reasonable cost of return shipping.
12.2 Change of Mind Returns
For Change of Mind returns, the customer is responsible for all return shipping costs. We recommend using a tracked shipping service, as Born A Real K9 is not responsible for products lost or damaged in return transit.
13. Packaging Returns
Returned products must be securely packaged to prevent damage during transit. Where a returned product is damaged during transit due to inadequate packaging by the customer, and the damage affects the condition of the product:
for Change of Mind returns, a partial refund or reduced Store Credit may apply, to the extent permitted by law; and
for ACL-based claims (faulty, damaged, or incorrectly supplied products), your statutory rights are not affected by transit damage caused by inadequate packaging, and we will assess the claim on its merits.
14. Exchanges
14.1 Availability
Exchanges are subject to stock availability at the time the return is processed.
14.2 Unavailable Items
If the requested exchange item is unavailable, we will offer:
Store Credit to the value of the returned product; or
a refund, where required by law; or
an alternative product of equivalent value, subject to your agreement.
15. Refund Processing
Approved refunds will be processed to the original payment method used at the time of purchase. Refunds are generally processed within 3–5 business days of approval. Additional processing time may apply depending on your financial institution.
16. Promotional Purchases, Bundles, and Gift With Purchase
16.1 Bundle Purchases
Where a product is purchased as part of a promotional bundle, all items included in the bundle may be required to be returned in order to receive a full refund or exchange. Partial returns of bundle items may result in a partial refund or Store Credit calculated on a pro-rata basis, to the extent permitted by law.
16.2 Gift With Purchase
Where a promotional gift was included with a purchase, the gift may be required to be returned along with the purchased product. If the gift is not returned, the value of the gift may be deducted from any refund or Store Credit, to the extent permitted by law.
16.3 Promotional Offers
Products purchased under a promotional offer (including discounted pricing, limited-time offers, or clearance sales) are subject to this Policy. Where a product is marked as final sale or clearance at the time of purchase, Change of Mind returns are not available. ACL rights are not affected.
17. Gift Cards
Gift cards are not eligible for return or exchange and cannot be redeemed for cash, except as required by law. Gift cards are subject to the terms and conditions published on our Website.
18. Hygiene Products
Opened grooming products (including shampoo, ear wipes, and paw balm) cannot be accepted for Change of Mind returns for hygiene reasons once the original seal has been broken.
Faulty or defective grooming products remain covered under the ACL and the Born To Work Promise regardless of whether the product has been opened.
19. Proof of Purchase
We accept the following as proof of purchase:

We may request proof of purchase before processing any return, exchange, or refund. If you are unable to provide proof of purchase, we will assess your request on a case-by-case basis. This does not affect your rights under the ACL.
20. Incorrect Deliveries
If Born A Real K9 sends you the wrong product, wrong colour, wrong size, or a damaged shipment, please contact us as soon as possible at support@bornarealk9.com with your order number and photographs. We will arrange an appropriate remedy in accordance with the ACL, which may include replacement, exchange, or refund.
21. Products Purchased from Unauthorised Resellers
Born A Real K9 products are only sold through our Website at bornarealk9.com and through authorised retail partners. Products purchased through unauthorised resellers are not eligible for our discretionary Change of Mind returns or the Born To Work Promise.
Your rights under the ACL in respect of faulty or defective goods are not affected by where you purchased the product, and you may have recourse against the seller from whom you purchased the product.
22. Abuse of Returns Policy and Fraudulent Claims
22.1 Policy Abuse
We reserve the right to refuse future discretionary Change of Mind returns where we reasonably believe our returns policy is being abused, including where a customer has made an unusually high number of returns or where returned products show evidence of use inconsistent with the stated reason for return.
22.2 Fraudulent Claims
We reserve the right to refuse a return, exchange, or refund where we reasonably believe a claim is fraudulent, including where products have been tampered with, damaged intentionally, or where false information has been provided.
22.3 ACL Rights Not Affected
Nothing in this clause limits your rights under the ACL. Refusal of a discretionary return does not affect any statutory remedy to which you may be entitled.
23. Counterfeit Products
Born A Real K9 does not accept returns of counterfeit or replica products. If you believe you have received a counterfeit product purporting to be a Born A Real K9 product, please contact us immediately at support@bornarealk9.com.
24. Gifts
If you received a Born A Real K9 product as a gift and wish to return it, please contact us at support@bornarealk9.com. Gift returns are assessed in accordance with this Policy. A gift receipt or order confirmation from the original purchaser may be required. Where a return is approved, refunds will generally be processed to the original purchaser where required by law, while approved gift returns may otherwise be issued as Store Credit to the gift recipient.

In this Promise, the following terms have the meanings set out below:
"Born A Real K9", "we", "our", and "us" means Born A Real K9 Pty Ltd (ABN 81 690 596 000).
"Promise" means this Born To Work Promise policy.
"Product" means any item purchased from bornarealk9.com or an authorised retailer.
"Manufacturing Defect" means a defect in materials, workmanship, or assembly that arises from the manufacturing process itself and renders the Product unfit for its intended purpose under normal use conditions. A Manufacturing Defect does not include damage caused by normal wear and tear, misuse, accidental damage, modification, improper fitting, improper cleaning, improper storage, environmental exposure beyond normal intended use, or damage caused by another animal.
"Normal Use" means use of the Product in the manner and for the purpose for which it was designed and supplied, in accordance with any care instructions provided.
"Working Dog Environment" means conditions associated with active working dog deployment, including but not limited to tracking, field work, bite work, search and rescue, herding, and similar high-performance activities.
"Authorised Retailer" means a retailer expressly authorised by Born A Real K9 to sell its Products.
"ACL" means the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).
"Cosmetic Wear" means surface-level changes to a Product's appearance that do not affect its structural integrity or functional performance, including minor scratches, scuffs, fading, and surface abrasion arising from normal use.
"Consumable Product" means any Product that is designed to be used up or depleted through normal use, including grooming products, shampoos, ear wipes, paw balm, and similar items.
1. What Is the Born To Work Promise?
Born A Real K9 designs and supplies equipment for active dogs, working dogs, and the owners who depend on them. Every product we make is built to perform — not to sit on a shelf.
The Born To Work Promise is our voluntary commitment that if a Product suffers a genuine Manufacturing Defect during normal intended use, we will inspect the Product and work with you to provide an appropriate solution.
This Promise operates in addition to your rights under the Australian Consumer Law. It does not replace, limit, or exclude any statutory rights you hold as a consumer under the ACL or any other applicable law. Where there is any inconsistency between this Promise and your ACL rights, your ACL rights prevail.

Where an incorrect supply occurs, Born A Real K9 will arrange return shipping at our cost and dispatch the correct item promptly.
4. Manufacturing Defect — Assessment
To assess a claim under this Promise, Born A Real K9 may request one or more of the following:
Photographs of the defect
Video footage demonstrating the defect
Return of the Product for physical inspection
Manufacturer assessment
Independent assessment where the nature of the defect requires it
We will communicate clearly with you throughout the assessment process and aim to provide a resolution outcome within a reasonable timeframe.
Born A Real K9 reserves the right to inspect any returned Product before determining an appropriate outcome. This right of inspection does not affect your rights under the ACL.
5. What the Promise Does Not Cover
The Born To Work Promise does not apply to the following:
Normal wear and tear arising from regular use
Cosmetic wear, including surface scratches, scuffs, fading, and minor abrasion that do not affect the Product's function
Normal deterioration of materials over time through regular use
Damage caused by chewing (by the dog wearing the product or any other animal)
Accidental damage
Misuse or abuse of the Product
Modification of the Product after purchase, including alterations, repairs, or additions carried out by any person other than Born A Real K9
Improper fitting or adjustment
Improper storage
Failure to follow product care or use instructions
Damage caused by another animal
Damage caused by environmental exposure beyond the Product's normal intended use
Products purchased through unauthorised resellers
Products altered after purchase
Improper cleaning or use of cleaning products not recommended for the Product
Consumable products becoming empty through normal use
Third-party repairs or modifications that affect the Product's integrity or performance
Products that have been used in a manner inconsistent with their intended purpose
Nothing in this section limits your rights under the ACL.
6. Working Dogs and High-Performance Use
Born A Real K9 builds products for working dogs and active companion dogs. We understand that working dog environments place significantly greater stress on equipment than ordinary domestic use.
The following are expected outcomes of working dog use and do not, by themselves, indicate a Manufacturing Defect:
Surface scratches and abrasion from field work or bite work
Mud and dirt ingress from tracking or field deployment
Water exposure from water work or outdoor conditions
Sun fading from extended outdoor use
General wear consistent with regular working dog activity
We design our products to withstand these conditions. However, no equipment lasts indefinitely under sustained high-performance use, and regular inspection and timely replacement of worn equipment is part of responsible working dog ownership.
This section does not affect your rights under the ACL. If a Product fails to meet the consumer guarantees under the ACL, your statutory rights apply regardless of the nature of use.
7. Product Care
To get the best performance and longest life from your Born A Real K9 equipment, we recommend the following:
Inspect all equipment regularly, particularly before and after working dog deployment
Replace any Product showing excessive wear, fraying, or structural compromise before continued use
Use each Product only for its intended purpose
Follow all care and cleaning instructions provided with the Product or published on our website
Store Products appropriately when not in use, away from prolonged direct sunlight, moisture, and extreme temperatures
Proper care and maintenance extends the life of your equipment and helps ensure it performs when it matters most.
8. How to Make a Claim
Step 1 — Contact Us

Step 2 — Provide Information
To assess your claim, please provide:
Your order number
A description of the issue
Photographs or video clearly showing the defect
Step 3 — Assessment
We will review the information provided and may request additional photographs, video, or return of the Product for physical inspection.
Step 4 — Return (If Required)
If a physical inspection is required, we will advise you of the return process. Where the claim is assessed as a Manufacturing Defect, Born A Real K9 will cover reasonable return shipping costs.
Step 5 — Resolution
Once the assessment is complete, we will contact you with the outcome and the proposed resolution.
9. Possible Outcomes
Depending on the outcome of the assessment, Born A Real K9 may offer one or more of the following:
Repair of the Product
Replacement with the same or an equivalent Product
Refund where appropriate
An alternative Product of equivalent value
Store credit where appropriate
Any other remedy required by law
Equivalent Replacement and Discontinued Products
Where a Product has been discontinued, Born A Real K9 will offer a replacement with the closest available equivalent Product. Where a Product has been updated, improved, or redesigned since the original purchase, the replacement offered may reflect the current production version rather than the original. Born A Real K9 does not guarantee the availability of identical replacement Products for limited production runs or discontinued lines.
Product Improvements and Design Changes
Born A Real K9 continuously improves its products. Replacement Products may incorporate design changes, material updates, or manufacturing improvements compared to the original Product. These changes do not affect the validity of a claim or the outcome offered.
10. Australian Consumer Law
Nothing in this Promise excludes, limits, or replaces any right or remedy available to you under the Australian Consumer Law or any other applicable legislation.
If a Product has a major failure as defined under the ACL, you are entitled to choose a refund, replacement, or compensation for the drop in value. You are also entitled to compensation for any other reasonably foreseeable loss or damage.
If a Product has a minor failure, Born A Real K9 will provide a free repair within a reasonable time, or if we cannot do so, a replacement or refund.
This Promise is a voluntary commitment that operates alongside your statutory rights. It does not diminish them in any way.
11. Product Assessment
Born A Real K9 reserves the right to inspect any Product that is the subject of a claim under this Promise before determining an appropriate outcome. Assessment may include:
Review of photographs and video provided by the customer
Physical inspection of the returned Product
Assessment by the manufacturer or supplier
Independent assessment where the nature or extent of the defect requires it
Assessment will be conducted in good faith and within a reasonable timeframe. Born A Real K9 will communicate the outcome of the assessment clearly and promptly.
12. Fraudulent Claims
Born A Real K9 takes the integrity of this Promise seriously. Claims that are fraudulent, intentionally misleading, or based on deliberate misrepresentation of the condition or history of a Product may be refused.
Nothing in this section limits any right or remedy available to you under the ACL.
13. Counterfeit Products and Unauthorised Sellers
This Promise applies only to Products purchased from:

an Authorised Retailer of Born A Real K9
Products purchased through unauthorised resellers, third-party marketplaces not expressly authorised by Born A Real K9, or any other channel not listed above are not covered by this Promise.
Born A Real K9 does not manufacture, supply, or endorse counterfeit products. Counterfeit products are not covered by this Promise under any circumstances.
To ensure you are purchasing genuine Born A Real K9 products, we recommend purchasing directly from bornarealk9.com or contacting us to confirm whether a retailer is authorised.
14. Third-Party Repairs and Modifications
Any Product that has been repaired, modified, or altered by a person or business other than Born A Real K9 after the date of purchase is not covered by this Promise. Third-party repairs or modifications may affect the structural integrity and performance of the Product and may void the Promise in respect of that Product.
This does not affect your rights under the ACL in respect of defects that existed at the time of purchase.
